Last updated: December 1, 2025 These terms of service (hereinafter the "Terms") govern access to and use of the website server-hytale.com (hereinafter the "Site"), published by Overheat Studio. By accessing the Site and using its services, you unconditionally accept these Terms. If you do not accept these terms, please do not use the Site. SITE PUBLISHER The Site is published by Overheat Studio, a company with share capital of 4500 euros, registered with the trade and companies register under SIRET number 98751411400014, whose registered office is located at 17 boulevard de Berlin, 44000 Nantes, France. The Site is hosted by OctoGency SARL, registered under SIRET number 844 727 594 R.C.S Castres. SERVICE DESCRIPTION The Site is a listing and ranking platform for game servers for the video game Hytale. The Site allows users to discover game servers, vote for their favorite servers and, for server administrators, to add and promote their own servers. The Site is in no way affiliated with Hytale Studios and constitutes an independent initiative by the gaming community. ACCESS TO THE SITE Access to the Site is free for all users with Internet access. Connection fees and equipment necessary to access the Site remain the sole responsibility of the user. Overheat Studio reserves the right to modify, suspend or interrupt all or part of the Site at any time, without notice or compensation. Overheat Studio cannot be held responsible for service interruptions and their consequences. ACCOUNT CREATION Creating a user account is mandatory to add a server to the Site or to access the premium program. To create an account, the user must provide a valid email address and choose a username. The user can create their account via the Site's native registration system (email and password) or via the proposed OAuth authentication systems (Google, Discord, GitHub). The user undertakes to provide accurate and up-to-date information during registration and to keep it up to date. The user is responsible for the confidentiality of their login credentials and all activities performed from their account. In the event of unauthorized use of their account, the user must immediately inform Overheat Studio via the address [email protected]. VOTING FOR SERVERS Users can vote for servers listed on the Site without creating an account. To vote, the user must provide their Hytale username. Each user can only vote once per defined period for the same server. The Site records the IP addresses of voters to ensure the integrity of the voting system and prevent fraudulent multiple votes. ADDING AND MANAGING SERVERS Server administrators can add their server to the Site after creating a user account. By adding a server, the administrator declares and guarantees that they are the legal representative of the server in question or have the necessary authorization to represent it. The administrator undertakes to provide accurate and complete information about their server and to keep this information up to date. The server administrator accepts the following obligations: provide an honest and non-misleading description of their server, respect the intellectual property rights of Hytale Studios and third parties, not publish illegal, offensive, defamatory or inappropriate content, maintain their game server in reasonable working condition. PROHIBITIONS AND PROHIBITED BEHAVIORS It is strictly prohibited for users and server administrators to use external means, computer programs, automated scripts, bots or any other artificial method to fraudulently increase a server's ranking or manipulate the voting system. Any attempt at manipulation will be sanctioned by immediate deletion of the server concerned and suspension or permanent deletion of the user account. It is also prohibited to use the Site to publish or transmit any illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, discriminatory or otherwise objectionable content, to infringe the intellectual property rights of third parties, to distribute viruses, malware or any other harmful code, to impersonate another person or entity, to collect personal data from other users without their consent, to use the Site for unauthorized commercial purposes. LIABILITY Overheat Studio implements all reasonable means to ensure the proper functioning of the Site, but cannot guarantee that the Site will be free from errors, bugs or interruptions. The Site is provided "as is" and Overheat Studio gives no warranty, express or implied, concerning the Site. Overheat Studio is not responsible for game servers listed on the Site. Each server is under the exclusive responsibility of its administrator. Overheat Studio cannot be held responsible for the content, availability, security or any other characteristic of listed servers. Users access game servers at their own risk. Overheat Studio cannot be held responsible for any direct or indirect damage resulting from the use or inability to use the Site, data loss, unauthorized access to a user account or any other damage related to the use of the Site. INTELLECTUAL PROPERTY The Site and all its content (texts, images, graphics, logos, icons, source code, structure) are the exclusive property of Overheat Studio or its partners and are protected by French and international laws relating to intellectual property. Any reproduction, representation, modification, publication or adaptation of all or part of the Site, by any means whatsoever, is strictly prohibited without prior written authorization from Overheat Studio. The trademarks, logos and other distinctive signs displayed on the Site are the property of their respective owners. The name and logo "Hytale" are the property of Hytale Studios. The Site is not affiliated with, endorsed, sponsored or specifically approved by Hytale Studios. MODIFICATION OF THE TERMS Overheat Studio reserves the right to modify these Terms at any time. Modifications will take effect upon their publication on the Site. It is the user's responsibility to regularly consult the Terms to be aware of any modifications. Continued use of the Site after publication of modifications constitutes acceptance of these modifications. TERMINATION Overheat Studio reserves the right to suspend or delete, at any time and without notice, a user's access to the Site in case of violation of these Terms, fraudulent or abusive use of the Site or behavior that undermines the integrity of the Site or its users. The user may at any time delete their account by contacting Overheat Studio at [email protected]. Account deletion results in the permanent deletion of all associated data, in accordance with the Site's privacy policy. PERSONAL DATA The processing of personal data collected on the Site is governed by our privacy policy, available at https://server-hytale.com/privacy-policy. By using the Site, you accept the practices described in this policy. APPLICABLE LAW AND JURISDICTION These Terms are governed by French law. Any dispute relating to the interpretation or execution of these Terms falls under the exclusive jurisdiction of French courts. In case of dispute, an amicable solution will be sought before any legal action.
